# Responsibilities
Company Side
We are responsible for the proper provision of all travel services included in your package, as set out in your confirmation invoice. Subject to these Booking Conditions, if we or our suppliers negligently perform or arrange those services and we don’t remedy or resolve your complaint within a reasonable period of time, and this has affected the enjoyment of your package holiday you may be compensated. You must inform us without undue delay of any failure to perform or improper performance of the travel services included in this package. The level of any such compensation will be calculated taking into consideration all relevant factors such as but not limited to: following the complaints procedure as described in these Booking Conditions and the extent to which ours or our employees’ or suppliers’ negligence affected the overall enjoyment of your holiday.
Client SideBy booking, you agree that you reviewed the standards and requirements of Blue Whales, including but not limited to minimum diving certification requirements, diving insurance requirements, personal information that Blue Whales requires you to provide, and forms that Blue Whales requires you to sign, such as Medical Statement, Liability Release or Assumption of Risk Agreement forms. You are responsible for understanding and complying with the requirements and we encourage you to enquire Blue Whales about requirements prior to making a reservation. Failure to comply with the requirements may result in your inability to use our services, and late cancellation fee may apply.
# Booking & Paying For Your Arrangements
In the case of booking a diving safari with a Liveaboard with Blue Whales, all the fees, costs, charges, and taxes paid in advance according to the booking confirmation with respect to Diving Services are collected by Blue Whales authorized salesperson on behalf of the Liveaboard in the currency indicated in the booking confirmation.
The exchange rate on Blue Whales Safari Liveaboards Website is for informative purposes only; the applicable exchange rate is determined on the date of payment and may be different from the exchange rate at the time of booking. In accordance with Blue Whales Terms, Blue Whales may charge deposit fee or request credit card details in order to confirm the Reservation. In such case, Blue Whales will send guidelines and collect the credit card information directly. bluewhales-safari.com will not collect or store the credit card information on its servers.
In some cases extra information (for example, but not limited to passport copies, evidence of guest insurance, health certificates, flight details, etc.) is needed to make a reservation complete. We hold the right to cancel the reservation according to the applicable booking policy for the particular booking in case this information is not supplied by the guest.
Noting that trips itinerary showen in each of them is an example of the planned route and dive sites cannot be guaranteed. All dives sites are subject to weather conditions and the final route taken is at the absolute discretion of the captain and dive guides. Adverse weather can affect the routes.
# Dive Qualification & Dive Experience Requirements
If your holiday requires any Mandatory or Recommended minimum dive qualifications and experience, in order to participate in diving on your holiday you will be notified before booking.
You will be required to present the qualification card(s) and recent log book(s)upon check-in onto the vessel to prove your Mandatory or Recommended dive qualifications and experience.
Important Note: Where the required qualification card(s) and recent log books are not presented or the dive crew are not satisfied that you meet the minimum dive qualifications, safety requirements or experience for the dive, the dive crew have final judgement and have the right to refuse access to the dive sites during the holiday.
During the holiday, guests are responsible for their own dive profiles and must stay within the limits of their certification, follow dive computer guidelines and make safety stops. They must also follow any instruction given by the dive crew aboard the vessel.
It is recommended that all divers hold the correct minimum diving qualification (or equivalent) and minimum number of logged dives for the itinerary you are booked on.

# Health Requirements
The provision of activities during your holiday is dependent on you being medically fit to participate in the activities. You are strongly advised to undergo a full medical examination before your holiday. If you are 18 weeks pregnant (or more) on the date of departure, you must provide us with a medical certificate proving that you are fit to travel and able to participate in the activities on your booking.
We reserve the right to prevent your participation in any activities if you are deemed medically unfit to do so or in our sole discretion, you are not fit to participate in the activities.
If you hold a diving medical certificate, a copy of the certificate should be taken on your holiday.
# Delays, Missed Transport Arrangements and other Travel Problems
In case you or any member of your party misses your flight or other transport arrangement, it is cancelled or you are subject to a delay of over 10 hours for any reason, you must contact us and the airline or other transport supplier concerned immediately.
In case that you cannot attend you holiday due to a delay or travel problems, We cannot accept liability for any delay and no payment will be refunded.
# Cancelling booking or transfer before departure
If you or any other member of your party decides to cancel your confirmed booking you must notify us by email or telephone. Your notice of cancellation will only take effect when it is received in writing by us at our offices and will be effective from the date on which we receive it.
Since we incur costs in cancelling your arrangements, unless specifically agreed otherwise, in which case you have to follow our Cancellation policy, you will have to pay the cancellation charges.
Cancellation Policy :
• 30% of your total will be charged of you cancel of make any changes from 6 months prior to your scheduled arrival date.
• 50% of your total amount will be charged if you cancel or make any changes from 3 months prior to your scheduled arrival date.
• 70% of your total amount will be charged if you cancel or make any changes from 1 months prior to your scheduled arrival date.
• 100% of your total amount will be charged if you cancel or make any changes on your scheduled arrival date or No show.
• In case travel to Egypt is not possible due to closed borders, the trip will be postponed to the next year.
Please note that transfer charges are not refundable in any circumstances. Where possible, we will deduct the cancellation charge(s) from any monies you have already paid to us.# If we (Blue Whales) cancel or change booking plan
Change Booking :
As we plan your holiday arrangements many months in advance we may occasionally have to make changes or cancel your booking and we reserve the right to do so at any time.
If we make a minor change to your holiday, we will make reasonable efforts to inform you or your travel agent as soon as reasonably possible if there is time before your departure but we will have no liability to you. Examples of minor changes include alteration of your outward/return flights by less than 10 hours, changes to aircraft type, change of accommodation to another of the same or higher standard, changes of carriers, changes to vessels, changes to the vessel departure port resulting in a delay of less than 10 hours, changes to dive sites and dive times by less than 10 hours. Where a vessel departure port is changed, we will endeavour to provide transport from the original departure to the new departure. Please note that carriers such as airlines and vessels used in the brochure may be subject to change.
Cancellation :We will not cancel your travel arrangements less than thirty (30) days before your departure date, except for reasons of Events Beyond our Control. We may cancel your holiday before this date if, e.g., the minimum number of clients required for a particular travel arrangement is not reached.
If we have to make a significant change or cancel, we will tell you as soon as possible and if there is time to do so before departure.

In no event will bluewhales-safari.com or its affiliated companies, directors, employees, agents, or contractors (the "Representatives") be liable for any cost, loss, damage, or injury whatsoever (including but not limited to personal injury or death, punitive damages, direct or indirect damages, and consequential damages) and including without limiting the generality of the foregoing, cost, loss, damage, or injury related to

• Interruption, delay or inability to use the Website or the Online Reservations System, and damage to computer equipment or other property;.
• inaccurate, incomplete, unreliable, or misleading information; or any act or omission of Blue Whales or its directors, officers, agents, employees, or contractors including but not limited to any and all claims related to the Reservation or Blue Whales Services.

Blue Whales is a work in progress, meaning that a lot will change in the near future. We reserve the right to update the Website and both Terms and Conditions and Privacy Policy from time to time, at our discretion. We will make sure to announce any major change in a prominent way, but since “major” is a very subjective concept, you can always monitor this page or subscribe to our newsletter.
